RW&M attorneys obtained a $2.7 million judgment on behalf of an international manufacturer of building materials against a former executive for fraud, breach of fiduciary duty and breach of contract.

RW&M recently obtained a walk-away settlement on behalf of a national homebuilder. A home purchaser had filed an arbitration demand against the client, alleging his house had construction defects. After demonstrating its client was not liable for any alleged construction defect, RW&M persuaded the homeowner to withdraw his arbitration demand, resulting in substantial fee and cost savings to the client.

RW&M attorneys obtained summary judgment on behalf of its client, an international supplier of building materials, in a premises liability and negligence case. The plaintiff sought more than $4.5 million for injuries sustained while at one of the client's manufacturing plants. RW&M won summary judgment after obtaining admissions from the plaintiff that no part of the client's premises caused him injury and that a person who allegedly caused him injury was not controlled by the client.

RW&M recently obtained a $684,336 AAA arbitration award, including attorneys’ fees, costs, and interest, on behalf of its client, a worldwide manufacturer of children’s educational games. RW&M proved that the defendant, an international manufacturer of video games, had breached a supply and distribution agreement and a stock purchase agreement.

RW&M attorneys obtained a substantial monetary settlement on behalf of its client, a nationwide developer, after it was discovered that a seller of real property failed to disclose to the developer a material fact concerning the property.

RW&M brought a motion on behalf of a nationwide home products retailer for the opposing party’s destruction of evidence. The court granted the motion and awarded RW&M’s client over $16,000 in sanctions. In addition, the court found that the jury should receive an “adverse inference” instruction to allow a finding that the destroyed documents were harmful to the opposing party.

RW&M recently resolved a Federal Court case for its client, a manufacturer of heavy machinery sued for more than $4 million by a purchaser of its machines who claimed they were defective. Under the terms of the settlement, the client paid no money and regained possession of the machines. After confirming that none of the defects alleged in the lawsuit ever actually existed, the client was able to resell the machines for an amount that covered all of its attorneys’ fees and yielded a six-figure net profit.

RW&M obtained a substantial settlement on behalf of an international executive against his former employer, a worldwide medical products manufacturer and distributor, for unpaid compensation.

On behalf of its client in a lawsuit for non-payment of the six-figure purchase price for industrial machinery, RW&M recently recovered the entire balance due, including interest at the annual rate of 18% and all of the client’s attorneys’ fees and litigation costs.
